These Terms and Conditions ("Terms") govern your use of Axon Health, Inc.'s ("Axon," "we," "us," or "our") platform, website, and messaging services. By using our services, you agree to these Terms.
1. SMS Messaging Program

Axon Health Patient Engagement Messaging
Program description
Axon Health sends text messages on behalf of healthcare practices to patients for appointment reminders, follow-up communications, recall notifications, and patient engagement purposes. Messages are conversational and may include scheduling assistance.
Message frequency
Message frequency varies. Patients may receive up to 3 messages per engagement campaign, with additional messages if a two-way conversation is initiated. Recurring messages may be sent for ongoing care coordination.
Message and data rates
Message and data rates may apply. Contact your wireless carrier for details about your text messaging plan.
Opt-in
By providing your phone number to a healthcare practice using Axon Health services, and consenting to receive text messages, you agree to receive automated text messages from that practice via our platform. Consent is not a condition of receiving healthcare services.
Opt-out
You can opt out at any time by replying STOP to any message. You will receive a confirmation message and no further messages will be sent. You may also text CANCEL, UNSUBSCRIBE, or QUIT.

Supported carriers
Our messaging services are available on all major US carriers including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.
2. Platform Services
Axon Health provides a healthcare operations platform for medical, dental, and specialty practices. Our services include but are not limited to: patient engagement campaigns, AI reception, billing and revenue cycle management, clinical documentation, and practice analytics.
3. Eligibility
Our platform services are intended for licensed healthcare providers and their authorized staff. Our messaging services are intended for patients of healthcare practices that use our platform. You must be at least 18 years of age to use our services.
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose
- Send unsolicited messages or spam through our services
- Attempt to gain unauthorized access to our systems
- Interfere with the operation of our services
- Misrepresent your identity or authority to act on behalf of a practice
5. HIPAA and Compliance
Healthcare practices using our platform agree to enter into a Business Associate Agreement (BAA) with Axon Health. We maintain HIPAA-compliant infrastructure and processes for handling Protected Health Information (PHI).
6. Intellectual Property
All content, features, and functionality of the Axon Health platform are owned by Axon Health, Inc. and are protected by copyright, trademark, and other intellectual property laws.
7. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that messages will be delivered to all recipients, as delivery depends on carrier networks and recipient device status.
8. Limitation of Liability
To the maximum extent permitted by law, Axon Health shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to undelivered messages or service interruptions.
9. Termination
We may suspend or terminate access to our services at any time for violation of these Terms or for any other reason at our discretion. Healthcare practices may terminate their use of our services in accordance with their service agreement.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to active users. Continued use of our services after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
